Nexus One is a business technology platform developed by Brand Works App LLC. The Nexus One mobile application provides mobile access to the broader Nexus One ecosystem, including business applications, services, workflows, automation, artificial intelligence, integrations, and other tools provided through Nexus One.

Nexus One is built using a hybrid development model. Nexus One contains both proprietary software developed by Brand Works App LLC and third-party or open-source software components.

Certain portions of the Nexus One platform are based upon, integrate with, interact with, extend, or utilize open-source software and third-party technologies. Those components remain governed by their respective copyright holders and license agreements. Brand Works App LLC does not claim ownership of third-party or open-source software merely because that technology is used within Nexus One.

However, Nexus One also contains substantial original and custom software developed specifically for the Nexus One platform, including proprietary code, integrations, interfaces, workflows, configurations, software architecture, automation systems, AI implementations, mobile functionality, design systems, and other original developments. Those proprietary portions of Nexus One remain the intellectual property of Brand Works App LLC and/or their respective rights holders.

Nexus One includes original software written specifically for the Nexus One ecosystem. This may include original:

• Custom source code
• Mobile application code
• Backend functionality
• APIs
• API integrations
• Business logic
• Automation systems
• AI functionality and AI integrations
• Application modules
• User interfaces
• Mobile interfaces
• Database implementations
• Data relationships
• Workflows
• Security implementations
• Authentication systems
• Software architecture
• Integration layers
• Business processes implemented through software
• Custom extensions
• Custom plugins
• Proprietary configurations
• Original design systems
• Nexus One-specific features
• Nexus One-specific modifications and enhancements

These original portions of the platform are separate from the underlying open-source or third-party technologies upon which certain parts of Nexus One may depend. Using an open-source framework, library, platform, or component does not automatically make Nexus One’s independently developed proprietary code open source.

Any rights granted to users regarding open-source components are determined by the applicable open-source licenses. Any rights relating to proprietary Nexus One code are governed by Nexus One’s applicable agreements, Terms of Service, licensing agreements, and applicable law.

Nexus One makes use of open-source and third-party software. Each open-source component remains governed by its respective license.

Nothing in the Nexus One copyright notice should be interpreted as removing, restricting, replacing, or overriding rights granted under an applicable open-source license. Likewise, Brand Works App LLC’s use, modification, integration, or distribution of open-source software does not transfer ownership of Brand Works App LLC’s independently developed proprietary Nexus One intellectual property unless expressly required by the applicable software license.

Original materials created for Nexus One by Brand Works App LLC and/or Byron Guerrero, as applicable, are protected by applicable copyright, trademark, intellectual-property, and other laws. This may include original:

• Software
• Source code
• Application architecture
• Interfaces
• Screen designs
• Graphics
• Visual assets
• Written content
• Product documentation
• Workflows
• Original databases or database structures where legally protectable
• Original software implementations
• Nexus One-specific functionality
• Brand presentation
• Audiovisual materials
• Mobile application content

Brand Works App LLC does not claim ownership over third-party software or open-source software owned by other parties.

The following may constitute proprietary Brand Works App LLC brand assets: the Nexus One name, Nexus One logos, product identity, visual identity, icons, original graphics, brand presentation, product terminology, marketing assets, slogans, and original interface branding.

These assets may not be used in a manner that falsely suggests authorization, affiliation, sponsorship, endorsement, or ownership by Brand Works App LLC. Use Nexus One™. Nexus One® is not used unless the trademark has actually been registered.

The restrictions described in this section apply specifically to proprietary Nexus One intellectual property and do not override rights granted under applicable open-source licenses. Except where allowed by law, contractual agreement, or an applicable license, users may not:

• Copy proprietary Nexus One source code.
• Redistribute proprietary Nexus One source code.
• Sell unauthorized copies of proprietary Nexus One software.
• Remove proprietary copyright notices.
• Remove ownership notices.
• Misrepresent proprietary Nexus One software as their own creation.
• Reproduce protected Nexus One branding for unauthorized commercial purposes.
• Falsely represent another application or service as Nexus One.
• Claim sponsorship or affiliation with Brand Works App LLC without authorization.
• Circumvent licensing restrictions applicable to proprietary portions of Nexus One.

Open-source components remain governed independently by their applicable licenses.

Third-party product names, trademarks, frameworks, platforms, libraries, and company names referenced by Nexus One remain the property of their respective owners. Use of a third-party technology within Nexus One does not automatically imply sponsorship, partnership, endorsement, or ownership.

Unauthorized reproduction, distribution, modification, commercial exploitation, impersonation, or use of proprietary Nexus One intellectual property may violate applicable copyright, trademark, contractual, licensing, or other laws.
